A Quick Update for Employers
We’ve been getting questions lately about which version of the Form I‑9 employers should be using — especially with a new edition released in 2025. Here’s what you need to know.
Current I‑9 Versions
- New edition: Dated 1/20/2025, expires 5/31/2027
- Previous edition: Dated 8/1/2023, expires 7/31/2026
Can Employers Still Use the 2023 Form?
Yes. You may continue using the 8/1/2023 edition of Form I‑9 until its expiration date of 7/31/2026. There is no immediate requirement to switch to the 2025 edition, especially if you have a current supply of the 2023 form.

What’s Changed in the 2025 Edition?
The 2025 update introduces only minor language changes — nothing procedural, structural, or requiring retraining.
Key updates include:
- Terminology alignment:
- “Noncitizen authorized to work” → changed to “Alien authorized to work” to match language used in the E‑Verify system.
- “Gender” → changed to “Sex” on List B document descriptions, aligning with the terminology used on driver’s licenses and state IDs.
- DHS Privacy Notice (in the instructions, not the form itself):
- Language now addresses the employee directly (using “you” instead of “the employee”).
- Adds clarification about data handling and system use, including references to DHS privacy frameworks and E‑Verify documentation.
Again, these are editorial and compliance updates that do not require any action if you’re still using the 2023 form properly.
What Employers Should Do Now
- You may continue using the 8/1/2023 edition through July 2026.
- No changes to your onboarding process or documentation requirements are needed due to this update.
- If you use E‑Verify, be aware that the attestation language now refers to “alien authorized to work.” This matches the new form but is functionally the same category.
- When ordering new I‑9 forms or updating digital systems, consider transitioning to the 1/20/2025 edition to stay current.
